Committee hits back at Lex Libertas, ‘Parliament won’t be intimidated or silenced’
Parliament’s Portfolio Committee on International Relations and Cooperation has robustly defended its oversight role amid a growing dispute with advocacy group Lex Libertas, which accuses some organisations of bypassing South Africa’s democratic institutions and seeking to influence foreign governments on how to “punish South Africa.” The clash follows criticism from Lex Libertas executive director Ernst Roets over remarks made during recent parliamentary discussions on organisations accused of spreading misinformation about South Africa abroad. Lex Libertas criticised proposals by senior ANC figures, allegedly backed by International Relations Minister Ronald Lamola, to take action against South Africans and civil society organisations that engage foreign governments on issues affecting South Africa. Roets argued that proposals involving possible prosecution or citizenship-related measures target individuals accused of spreading misinformation abroad. Lex Libertas identified Parliament’s International Relations Committee chairperson, Supra Mahumapelo, as one of the ANC leaders behind the proposals. Stripping South Africans Responding to Roets’ open letter to Lamola, committee chairperson Mahumapelo rejected claims that Parliament was seeking to strip South Africans of their citizenship because of their political views. “No one in the committee has proposed that citizenship be withdrawn as punishment for holding a different political view,” the committee said. Instead, Mahumapelo argued that Parliament is entitled to examine how South Africa should respond when private organisations engage foreign governments in ways that could result in visa restrictions, economic pressure, or other measures affecting the country. “What was raised in Parliament last week was a principled policy question that Parliament is entitled to raise under Section 55(2) of the Constitution. It is not about disagreement. It is about conduct.” Foreign Lobbying At the centre of the dispute are claims taken abroad about South Africa’s political and social environment. The committee directly challenged allegations of a state-sponsored “white genocide” and claims of state-sanctioned farm attacks, describing them as false. Expropriations Act It also rejected assertions that the Expropriation Act permits arbitrary land seizures without compensation or judicial oversight, and disputed arguments that broad-based black economic empowerment (B-BBE) policies constitute race-based discrimination warranting sanctions or punitive action from foreign governments. “When such claims are taken to the United States and presented as fact to secure visa bans on South Africans, trade penalties and aid withdrawals that affect ordinary citizens, it ceases to be domestic debate; it becomes a foreign policy matter that this committee must oversee.” ‘Bring It to Parliament’ Mahumapelo dismissed suggestions that Parliament was attempting to silence critics, insisting that channels for engagement remain open. “The invitation to engage is genuine.” The committee noted that Parliament has previously held public hearings and committee processes on expropriation, transformation legislation, and South Africa’s relations with the United States. It also said neither Lex Libertas nor its representatives had ever approached the committee for an audience. Claims In one of the strongest statements, Mahumapelo challenged the organisation to submit its claims to public scrutiny. “Lex Libertas should present its evidence on farm attacks, property rights and transformation legislation under oath, in public and subject to questioning. That is the appropriate forum for evidence and counter-evidence, not a foreign legislature.” “If anyone has evidence of wrongdoing by government, bring it to Parliament. Bring it to court. Bring it to the Chapter 9 institutions,” he added. Patriotism or Punishment? Mahumapelo drew a sharp distinction between criticism of government and advocacy that could bring consequences to the country. “To criticise the government because you love South Africa is patriotic. To invite foreign punishment of South Africa because you dislike the government is something else entirely.” Citizenship He also rejected suggestions that his earlier remarks amounted to a call to revoke citizenship. “My call for consequences was not a call to strip citizenship arbitrarily. It was a call for accountability for misinformation that harms the country.” Parliament ‘Will Not Be Intimidated’ Mahumapelo insisted that Parliament would continue scrutinising the issue despite criticism. “What we cannot accept is a practice where some citizens consistently fail to engage domestic institutions and instead seek to become interlocutors for foreign governments on how to punish South Africa.” “We will not threaten anyone, but we will not be intimidated out of our oversight role either,” he added. Warning In a direct response to allegations that Parliament’s stance amounts to intimidation, Mahumapelo issued a warning of his own. “Threats will not silence anyone. But neither will accusations of threats silence Parliament.” He said the committee would continue working to “recalibrate US-SA relations, protect South Africa’s sovereignty and constitutional order, and defend the rights of all South Africans, including the right to disagree.”

ANC ruling sparks debate over precedent and voter rights
Though the Constitutional Court (ConCourt) has yet to explain its ruling on the ANC’s failed candidate submissions, anxiety is mounting over whether the decision could set a dangerous precedent or simply refine the Electoral Commission of South Africa’s (IEC) procedures. The judgment, delivered last week, allowed the ANC to resubmit lists for six municipalities after missing the 28 August deadline. ConCourt allowed ANC to resubmit lists The ConCourt overturned the Electoral Court’s earlier ruling, which had rejected the ANC’s explanation for non-submission. Independent political analyst Ralph Mathekga cautioned against rushing to label the ruling a precedent. “We can’t say it will set a dangerous precedent because we don’t know that. We can only deduce that after we review the reasoning the court provides,” he said. Mathekga said the IEC’s registration process itself has not yet received judicial evaluation. He expected the ConCourt’s eventual reasoning to scrutinise whether the IEC’s submission rules are fair and transparent. He said the ruling might have been driven by the need to protect voters. Caution against labelling ruling ‘dangerous precedent’ without reviewing reasoning “The court may have reasoned that excluding candidates over a technical glitch or unclear rule would deny citizens their constitutional right,” he said. Mathekga said the IEC could be compelled to tighten its submission process to avoid ambiguity. The case arose when the ANC failed to submit 181 candidates by the deadline, affecting candidates from Eastern Cape, KwaZulu-Natal and the Free State. The IEC refused to reopen submissions and the Electoral Court upheld that decision. The ANC appealed to the ConCourt, which granted relief. Many experts have said that pressing the final submission button was integral to the process and that the ANC should have been disqualified. The ConCourt’s intervention, however, suggested that voter rights might outweigh party incompetence or technical mishaps. Judgment might refine IEC’s processes Political analyst Goodenough Mashego said he had expected the ConCourt to side with the ANC after the Electoral Court rejected its appeal. He suggested the ruling may also have considered that three other parties in 2024 faced similar registration problems, but the ConCourt rejected their attempts to be given a second chance. The IEC has denied any glitches or breaches in its system, insisting the ANC failed to complete its submission. Mathekga said the judgment might refine the IEC’s processes, rather than set a precedent.

Chiefs showed me more respect than Orlando Pirates, says Bucs legend Jerry Sikhosana
Orlando Pirates legend Jerry Sikhosana feels he has not been treated well by his former club despite his years of service to the Buccaneers. Sikhosana famously scored in the 1995 CAF Champions League final against ASEC Mimosas, helping Pirates secure their only title in the competition’s history. The retired striker, however, believes the club has failed to show him the appreciation he deserves, revealing that he has been denied VIP treatment on several occasions. Speaking on the Kasi Jam podcast, Sikhosana expressed his frustration at having to queue alongside ordinary supporters to buy tickets to watch his former team in action. “You look at me walking, you look at the Pirates jersey, it has a star. The first impression that comes is Jerry Sikhosana, he gave us the star. But I will go to the ground, fold my arms and queue with the supporters to buy tickets,” he said. Kaizer Chiefs Give Orlando Pirates legend Special Treatment Sikhosana also recalled an incident at last year’s Nedbank Cup final in Durban, where he received attention from Kaizer Chiefs despite his history with their fierce Soweto rivals. The former striker was with ex-Chiefs goalkeeper Brian Baloyi when they went to the suites, where he encountered Thandi Merafe (Bucs media officer) and spotted former Pirates players Eddie Motale and Lucky Lekgwathi wearing the club’s new tracksuits for the final. “You can see that there are the two legends picked to represent the club for that game,” he said. After greeting Motale and Lekgwathi, Sikhosana was asked where his own uniform was. He responded by suggesting that he was no longer regarded as a legend because he was wearing his own clothes. The Pirates icon also explained how he struggled to get tickets to watch the match from the grandstand before bumping into Chiefs marketing director Jessica Motaung. “As I was leaving, on the stairs, I bumped into Jessica Motaung. She was told that Jerry was asking for tickets. She turned and asked how I was and said, ‘Don’t worry, we know where you are, you can be black on the outside, but we know how you are inside. That’s stress’,” Sikhosana recalled. ‘Where Are the People I Served?’ the Orlando Pirates legend asked. Sikhosana questioned why he received attention from Chiefs when he felt overlooked by the club where he made his name. “A person from Chiefs gave me attention, whereas I played for Pirates and the same team ignored me. I got special treatment from a rival, the same team I used to destroy. Where are the people I served during the derby?” he asked. The Bucs legend added that he has become accustomed to queuing with supporters whenever he wants to watch Orlando Pirates play. “I am no longer a legend, I take pictures with supporters, that’s what I tell them,” Sikhosana added. Do you think Sikhosana should be given VIP treatment?
